Actually they haven't lost yet. But the Dellinger case is hopeless.

Where do civil service laws apply?

When a civil service employee sues it goes first to the Merit Systems Protection Board. It will probably take months to be finished with the process. Only afterward can a civil service employee appeal to the federal court system.

And the Merit Systems Protection Board is probably controlled by the administration. I would guess the administration could probably turn the months into years.
